How do people use past experience to generalise to novel cases? This paper reports four experiments exploring the significance on one class of past experiences: encounters with negative or contrasting cases. In trying to decide whether all ravens are black, what is the effect of learning about a non-raven that is not black? Two experiments with preschool-aged, young school-aged, and adult participants revealed that providing a negative example in addition to a positive example supports generalisation. Two additional experiments went on (...) to ask which kinds of negative examples offer the most support for generalisations. These studies contrasted similarity-based and category-based accounts of inductive generalisation. Results supported category-based predictions, but only for preschool-aged children. Overall, the younger children showed a greater reliance on negative evidence than did older children and adults. Most things we encounter in the world are negative evidence for our generalisations. Understanding the role of negative evidence is central for psychological theories of inductive generalisation. (shrink)

Derrick Darby’s book Rights, Race, and Recognition defends the seemingly startling thesis that all rights, moral as well as legal, are dependent upon social recognition. So there are no “natural” rights independent of social practices, and subordinated groups in oppressive societies do not have rights. Darby appeals to intersubjectivist constructivism to make his meta-ethical case, but in this critique, I argue that he conflates, or at least fails to consistently distinguish, two radically different varieties of constructivism: idealized intersubjectivist constructivism, (...) which is objectivist, and non-idealized conventionalist constructivism, which is relativist. In neither case, then, can Darby establish the shocking thesis that white supremacy objectively takes away blacks’ moral standing. (shrink)

In few cases among modern religious ethicists are the contemporary issues concerning the problem of norms and of criteria more intriguingly brought to the fore than in the ethics of Martin Buber.

In this essay I describe how primary and secondary narcissism are the underlying and motivating psychological states for fundamentalist religious belief. I describe the psychodynamics that produce such a belief state and I make the case that the "fundamentalist personality" is best understood as a form of barely sublimated pathological narcissism. Given the brutality of the human condition, it is understandable why this psychological-metaphysical option is an enticing one, but I follow Ralph Ellis in the conclusion that the consequences (...) of such belief systems produce much more harm than benefit for individuals and humanity at Iarge. Depression is often diagnosed in patients nearing the end of their lives and medication or psychotherapy is prescribed. In many cases this is appropriate. However, it is widely agreed that a health care professional should treat sick persons so as to improve their condition as they define improvement. This raises questions about the contexts in which treatment of depression in late life is appropriate. This article reviews a problematic case concerning the appropriateness of treatment in light of the literature (...) in bioethics. Specific attention is paid to the concept of authenticity and the role of suffering. Suffering is often the result of a situation in which one's self is damaged. In some circumstances, this suffering should not be seen as a symptom of illness but as a reflection, in a difficult life context, of the individual's authentic nature. Assessment of depression in the elderly must go beyond a symptom list and must consider both the context of the individual's situation and his or her authentic self. When the symptoms reflect the individual's assessment of the situation in the context of the authentic self, they may be "appropriate." However, even when the symptoms are appropriate, if they interfere with life assessment and adjustment, treatment should be considered. (shrink)

OBJECTIVE: To describe the issues faced, and how they were addressed, by the University of Toronto Critical Care Medicine Program/Joint Centre for Bioethics Task Force on Appropriate Use of Life-Sustaining Treatment. The clinical problem addressed by the Task Force was dealing with requests by patients or substitute decision makers for life-sustaining treatment that their healthcare providers believe is inappropriate. DESIGN: Case study. SETTING: The University of Toronto Joint Centre for Bioethics/Critical Care Medicine Program Task Force on Appropriate Use of (...) Life-Sustaining Treatment. PARTICIPANTS: The 24-member Task Force included physician and nursing leaders from five critical care units, bioethicists, a legal scholar, a health administration expert, a social worker, and a hospital public relations professional. INTERVENTIONS: None. MEASUREMENTS AND MAIN RESULTS: Our specific lessons learned include a) a policy focus on process; b) use of a negotiation and mediation model, rather than a hospital ethics committee model, for this process; and c) the policy development process is itself a negotiation, so we recommend equal involvement of interested groups including patients, families, and the public. CONCLUSIONS: This article describes the key issues faced by the Task Force while developing its policy. It will provide a useful starting point for other groups developing policy on appropriate use of life-sustaining treatment. (shrink)

A recent debate over the causal foundations of evolutionary theory pits those who believe that natural selection causally explains long-term, adaptive population change against those who do not. In this paper, I argue that this debate – far from being an invention of several articles in 2002 – dates from our very first engagements with evolution as a quantified, statistical science. Further, when we analyze that history, we see that a pivotal figure in the early use of statistical methodology in (...) evolutionary theory, W.F.R. Weldon, changes his mind about precisely the central claim at issue. I close by drawing some morals which I think the case can offer for the contemporary debate going forward. (shrink)

One claim found in the received historiography of the biometrical school (comprised primarily of Francis Galton, Karl Pearson, and W. F. R. Weldon) is that one of the biometricians' great flaws was their inability to look past their population-focused, statistical, gradualist understanding of evolutionary change – which led, in part, to their ignoring developments in cellular biology around 1900. I will argue, on the contrary, that the work of the biometricians was, from its earliest days, fundamentally concerned with connections between (...) statistical patterns of inheritance and the underlying cellular features that gave rise to them. Such work remained current with contemporary knowledge of chromosomes, cytology, and development; in this article, I explore the first case. The biometricians were thus well positioned to understand the relationship between the patterns of Mendelian inheritance and the statistical distributions with which they primarily occupied themselves. Ignorance of this connection, then, is not the reason why they rejected Mendelism. Further, both Galton and Weldon – though each in their own unique way – decided to turn to biological detail as a way to better justify the generality of their statistical approaches to heredity. Perhaps paradoxically, then, for these biometricians, detail offered an approach to theoretical generality. (shrink)

We discuss the early career of John H. Van Vleck, one of the earliest American quantum theorists who shared the 1977 Nobel prize with his student Philip W. Anderson and Sir Nevill Mott. In particular, we follow Van Vleck's trajectory from his 1926 Bulletin for the National Research Council on the old quantum theory to his 1932 book, The Theory of Electric and Magnetic Susceptibilities. We highlight the continuity of formalism and technique in the transition from dealing with spectra in (...) the old quantum theory to dealing with susceptibilities in the new quantum mechanics. Our main focus is on the checkered history of a numerical factor in the so-called Langevin-Debye formula for the electric susceptibility of gases. Classical theory predicts, under very general conditions, that this factor is equal to 1/3. The old quantum theory predicted values up to 14 times higher. Van Vleck showed that quantum mechanics does away with this "wonderful nonsense" and restores the classical value 1/3 under equally general conditions. The Langevin-Debye formula thus provides an instructive example of a Kuhn loss in one paradigm shift that was regained in the next. In accordance with the expectation of Thomas S. Kuhn that textbooks tend to sweep Kuhn losses under the rug, Van Vleck did not mention this particular Kuhn loss anywhere in his 1926 NRC Bulletin. Contrary to Kuhn's expectations, however, he put the regained Kuhn loss in susceptibility theory to good pedagogical use in his 1932 book. Kuhn claimed that textbooks must suppress, truncate, and/or distort the prehistory of their subject matter if they are to inculcate the exemplars of the new paradigm in their readers. This claim is not borne out in this case. We argue that it is ultimately because of the continuity of formalism and technique that we draw attention to that Van Vleck could achieve his pedagogical objectives in his 1932 book even though he devoted about a third of it to the treatment of susceptibilities in classical theory and the old quantum theory in a way that matches the historical record reasonably well. Pippin's Philosophy by Other MeansCharles AltieriRobert Pippin's book is terrific in many ways.1 He not only makes Hegel's aesthetic theorizing lucid; he makes it extremely attractive, especially in his account of how artists double the sensuous world so that an artwork embodies the presence of the spirit's labor. And he proposes a forceful case that Hegelian thinking can honor the contributions art makes to (...) philosophy, given that a major challenge for philosophy is to capture "its own time reflected in thought." Hence G. W. F. Hegel treats works of literature "not as examples of an ideal or moral commitment or the expression of general norms, but as criterial aspects of just what it could be to espouse or avow such a value or, more important, … for such a value to lose its grip on its adherents" (p. 222, emphasis added).The opening of his second essay, on J. M. Coetzee, elaborates this claim by making two assertions—"that fiction can be a distinctive form of thought, even a form of knowledge," and "that such knowledge is relevant to, has a bearing on, the sort of knowledge that philosophy, or at least some version of philosophy tries to achieve" (p. 240). Modern literature, in particular, offers this knowledge largely because it is obsessed with problems of self-reflection that are also basic to the age's philosophical concerns. Hegel shows that in modernity, self-consciousness must establish new imaginative relations between subjectivity and what seem objective conditions in order to address the inherent tensions and senses [End Page 234] of contradiction inevitable when persons face historical change on this large a scale. And Pippin's essays on literature show how significant, and how disturbing, the need for understanding these efforts at shaping identity can become.II want first to register the kinds of observations Pippin's approach can develop for particular works of art. Then we will have a framework for clarifying and assessing his arguments, in ways that his dealing with art, especially modern writing, may help us dialectically stage how his views can be sublated. Pippin performs a minor, yet brilliant, example of sublation in his essay on Immanuel Kant's hatred of tragedy. Kant's aversion is based on his belief that we "cannot make ethical sense" (p. 35) of how tragedy contradicts anything reason can assert. (And in denying the power of moral reasoning, tragedy also denies the presence of the divine in human life.) This observation then becomes a difficult dilemma for philosophy: either we dismiss tragedy or we expand what counts as philosophy. But Pippin finds in philosophy the expansion he needs by deploying Friedrich Nietzsche's argument against Kant: what we "need in our response to tragedy is not understanding but strength" (p. 36).The issue of tragedy deepens in Pippin's first essay on literature, about Henry James's What Maisie Knew, but largely because of what Pippin does not address. Pippin emphasizes how James thinks Maisie demonstrates to herself and to others that she can ultimately understand her position regarding her dangerously charming parents and caregivers. In Maisie's final choice to leave with her caregiver nurse, Mrs. Wix, she takes responsibility for her relationship to her entire social circle and demonstrates to its members her capacity to free herself from them. She thereby satisfies Hegel's demand that self-knowledge can reasonably be claimed only when one acts on that knowledge; and is capable, when challenged, of standing behind what she has determined. For she then accomplishes two feats. Her action presents self-knowledge not as a report of an inner state but as "a reflexive stance taken up for reasons in a social world" (p. 171). And it does so in a context of "social contestations" rather than settling for a limited projection of herself to herself (p. 164). However, I claim later that while James is certainly impressed by Maisie, her knowledge does not prevent the tragic consequence of dooming her to a life where her multiple virtues are not [End Page 235] likely to be realized. The distinction between moral values and others is not an easy one. There are easy extremes: the value that one places on his neighbor's welfare is moral, and the value of peanut brittle is not. The value of decency in speech and dress is moral or ethical in the etymological sense, resting as it does on social custom; and similarly for observance of the Jewish dietary laws. On the other hand the eschewing of unrefrigerated oysters in the summer, though it (...) is likewise a renunciation of immediate fleshly pleasure, is a case rather of prudence than morality. But presumably the Jewish taboos themselves began prudentially. Again a Christian fundamentalist who observes the proprieties and helps his neighbor only from fear of hellfire is manifesting prudence rather than moral values.1 Similarly for the man with felony in his heart who behaves himself for fear of the law. Similarly for the child who behaves himself in the course of moral training; his behavior counts as moral only after these means get transmuted into ends. On the other hand the value that the child attaches to the parent's approval is a moral value. The preface by Parsons begins: “This book contains the most substantial philosophical papers I wrote for publication up to 1977, with one new essay added. … The collection is unified by a common point of view underlying the essays and by certain problems that are approached from different angles in different essays. Most are directly concerned with the philosophy of mathematics, and even in those that are not … the connection between the issues discussed and mathematics is never far from (...) the surface … in the Introduction I articulate some elements of my general point of view and point out some connections between the essays.“ The nine previously published papers are unrevised except in some cases for added postscripts and footnotes. Of the essays written for publication before 1977, essay 7, “Quine on the Philosophy of Mathematics,” has not been, in fact, previously published. The eleventh, “Sets and modality,“ is the new essay. A general point of view does indeed show itself in these essays, but it is rigorously subordinated to careful and balanced analyses of the problems discussed. ‘Racial justice’ is a term widely used in everyday discourse, but little explored in philosophy. In this essay, I look at racial justice as a concept, trying to bring out its complexities, and urging a greater engagement by mainstream political philosophers with the issues that it raises. After comparing it to other varieties of group justice and injustice, I periodize racial injustice, relate it to European expansionism and argue that a modified Rawlsianism relying on a different version of the thought (...) experiment could come up with suitable principles of corrective racial justice. During the decades following the publication of Darwin's Origin of species in 1859, religious belief in England and in particular the Church of England experienced some of the most intense criticism in its history. The early 1860s saw the appearance of Lyell's Evidence of the antiquity of man , Tylor's research on the early history of mankind , Renan's Vie de Jésus , Pius IX's encyclical, Quanta cura, and the accompanying Syllabus errarum, John Henry Newman's Apologia , and Swinburne's notorious (...) Atalanta in Calydon ; it was in this period also that Arthur Stanley was appointed Dean of Westminster, and that Bills were introduced in Parliament to amend or repeal the ‘Test Acts’ as they affected universities. They were the years that witnessed Lyell present the case for geology at the British Association at Bath , the first meeting of the X-Club , and the award of the Royal Society's Copley Medal to Charles Darwin. These were the years in which, as Owen Chadwick has put it, ‘the controversy between “science” and “religion” took fire’. (shrink)

After a brief summary of the 17 essays in Sally Haslanger’s (2012) collection, Resisting Reality: Social Construction and Social Critique, I raise questions in two areas, the defense of constructionism and the definition of gender and race in terms of social oppression. I cite Robin Andreasen’s and Philip Kitcher’s essays arguing (in different ways) that races are both biologically real and socially constructed, and also Joshua Glasgow’s claim that constructionist arguments ultimately fail. I then cite Jennifer Saul’s critique that “oppression” (...) definitions of gender and race run into problematic counterexamples, and add some other points arising from the different histories of gender and racial categories and realities. As someone sympathetic to constructionism myself, my aim is not a critique of Haslanger but rather an inquiry as to how she thinks (we) constructionists should answer such challenges. (shrink)

In many cases, the “therapeutic misconception” may be an unavoidable part of the imperfect process of recruitment and consent in medical researchPaul Appelbaum, Loren Roth, and Charles Lidz coined the term “therapeutic misconception” in 1982.1 They described it as the misconception that participating in research is the same as receiving individualised treatment from a physician. It referred to the research subject’s failure to appreciate that the aim of research is to obtain scientific knowledge, and that any benefit to the (...) subject is a by-product of that knowledge. More recent studies by Appelbaum and Lidz have shown that this phenomenon is just as pervasive now as it was twenty four years ago.2 The problem pertains not to any duty of care for researchers but to participants’ unfounded belief in the therapeutic potential of research.3 It is especially acute in phase I oncology trials, which aim to test the toxicity and highest tolerable dose of anticancer drugs.To remedy this situation, many have argued that both clinicians and researchers need to do more in explaining to subjects the differences between experimental research and standard care. Clinicians and researchers recruiting potential subjects for research must present information about the expected risks and benefits of participation in research in a more realistic and straightforward way.4 In one recent examination of consent forms for phase I oncology trials, Sam Horng et al found that, in the section on “benefit”, only one of 272 forms stated that the subjects were expected to benefit. They also found that 11 consent forms stated clearly that subjects would not benefit, 25 forms communicated uncertainty about benefit, and 5 forms said nothing about the chance of benefit. The “Occupy Wall Street!” movement has stimulated a long listing of other candidates for radical “occupation.” In this paper, I suggest the occupation of liberalism itself. I argue for a constructive engagement of radicals with liberalism in order to retrieve it for a radical egalitarian agenda. My premise is that the foundational values of liberalism have a radical potential that has not historically been realized, given the way the dominant varieties of liberalism have developed. Ten reasons standardly given as to (...) why such a retrieval cannot be carried out are examined and shown to be fallacious. (shrink)

This essay tries to develop a “black radical Kantianism”—that is, a Kantianism informed by the black experience in modernity. After looking briefly at socialist and feminist appropriations of Kant, I argue that an analogous black radical appropriation should draw on the distinctive social ontology and view of the state associated with the black radical tradition. In ethics, this would mean working with a (color-conscious rather than colorblind) social ontology of white persons and black sub-persons and then asking what respect for (...) oneself and others would require under those circumstances. In political philosophy, it would mean framing the state as a Rassenstaat (a racial state) and then asking what measures of corrective justice would be necessary to bring about the ideal Rechtsstaat. This previously-unpublished essay by the late Charles W. Mills (1951–2021) seeks to demonstrate the racially-structured character of the universe created by J. R. R. Tolkien in The Hobbit and The Lord of the Rings. Written long before the popular film series, the essay critically examines Tolkien's novels and comments on the nature of fictional creation. Mills argues that Tolkien designs a racial hierarchy in the novels that recapitulates the central racist myth of European thought.
